At the peak of Audigier's popularity as the most American of French designers, New York Magazine reveals he faces legal action from Marc Jacobs. The dispute centers on Jacobs' Pretty Nylon Tote bag, which Audigier's Ed Hardy brand allegedly copied outright. The lawsuit claims the Ed Hardy bag shares the "size, shape, color, design, material, and addition of materials and accessories" with Jacobs' original.

According to Here magazine, spokespeople for Audigier clarify that he personally is not the target; instead, a licensed manufacturer for the Audigier brand is implicated.
